Pre-Contract Information

We offer a marketing service for mis-sold pensions and investments.   In order to ascertain the basis and merits of the claim we will pass your details to one of panel solicitor firms who will carry out an initial assessment and if they deem your case to have good prospects of success, they will investigate and advise you on the merits of the claim further.  They will submit your claim and handle all communications. If an offer of compensation is made, they will assess this offer and provide you with a recommendation as to whether to accept it or not. Where your claim is rejected, they will assess the reasons behind the rejection and advise you on the merits of escalating the claim and, where appropriate, represent you in escalating your claim.  

Illustration of fees

The panel solicitor will not you charge you anything for the initial assessment of your case. Once they agree to act on your behalf, they will pay a fee to Clear Legal Marketing Ltd for making the introduction. This fee will not be deducted from your compensation. 

All our panel solicitors will act on a “no win no fee” basis which means that you only pay their fees in the event your case is successful and awarded compensation. Any fees will be deducted from your compensation and you are not required to pay anything upfront. 

Typically customers pay not more than 27% (inc VAT) of any amount recovered, although this will be subject to your individual circumstances and the actual fee may be more or less than this.

The standardised figures used above are for cost illustrations only and are not to be taken as an estimate of the amount likely to be recovered for you. The fee you will have to pay will be based on your compensation award which will vary based on the amount you invested. This means what you pay might be more or less than the illustrations shown above.

If you fail to cooperate or provide false or misleading information to your solicitor, you may be liable to pay any costs they incurred.  

 

Alternative Ways to Claim

You are not required to use our services to pursue your claim. You can also seek further advice or shop around.

It is possible for you to present the claim for free, either to the firm or person against whom you wish to complain or to the statutory ombudsman (Financial Ombudsman Service http://www.financial-ombudsman.org.uk or Pension Ombudsman Service https://www.pensions-ombudsman.org.uk) or the Financial Services Compensation Scheme https://www.fscs.org.uk, whichever is applicable to your claim.

What you have to do

You will need to complete our fact find and provide us with authority to request the relevant information needed to support our investigations and your claim.  You must provide us with any information and documents which are relevant to your claim. You must promptly reply to any requests for further information and documents that we may make.

Cancellation

If you wish to cancel this contract you can do so within 14 days at no cost. Just let us know.

If you cancel our service after 14 days and after we submit your claim you will be liable to pay our full success fee should your claim be successful.

If you end the agreement with the solicitor before your claim is completed or you breach the terms of the agreement, you may be liable for their costs and any expenses incurred.  Their costs will be calculated by reference to the time spent charged at the following hourly rates:

Solicitors with at least 8 years post qualification experience and fee earners with equivalent experience £250.00

Solicitors with at least 4 years post qualification experience and fee earners with equivalent experience £192.00

Solicitors with less than 4 years post qualification experience and fee earners of equivalent experience £161.00

Trainee Solicitors, Paralegals and fee earners of equivalent experience £118.00
